General Terms and Conditions of Sale (GTC)

2. Purpose
These General Terms and Conditions of Sale (hereinafter “GTC”) govern all sales made by Mon Petit Pinpin - Pestana Créations SRL via its website or any other online sales channel. They define the rights and obligations of the seller and the buyer in connection with the sale of artisanal products, whether personalized or not. Any order implies the full and unreserved acceptance of these GTC by the buyer.
3. Products
The products offered are artisanal and customizable creations. Each item is described and photographed with the greatest possible accuracy, but slight variations may exist (color, shape, texture, engraving), inherent to manual manufacturing. Personalized products (engraving, first name, color, specific design, etc.) are made to order and cannot be returned or exchanged, except in the case of a proven defect or non-conformity.
4. Orders
An order is considered final upon receipt of full payment. The seller reserves the right to refuse or cancel any order in the event of a dispute, obvious error, or suspicion of fraud. The buyer must carefully check all personalization information (spelling, colors, choice of patterns, etc.) before validation.
5. Price and Payment
Prices are indicated in euros (€), all taxes included (TTC). Delivery costs are not included in the displayed prices and are specified during the ordering process.
Accepted payment methods: Credit card, PayPal, bank transfer, Bancontact, cash, Payconiq.
The order is considered confirmed only after payment validation.
6. Manufacturing and Delivery Times
• Manufacturing: 5 to 9 business days on average, depending on the complexity of the personalization and workload.
• Delivery: between 2 and 10 business days depending on the chosen shipping method and the destination country.
These times are indicative and may vary in cases of force majeure (strikes, transport delays, stock shortages, etc.).
In case of significant delay, the buyer will be informed as soon as possible.
The transfer of risks (loss or damage) occurs upon delivery of the package to the address indicated by the buyer.
7. Right of Withdrawal
In accordance with European legislation (Directive 2011/83/EU and Belgian law), the buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal, except for:
• personalized or custom-made products.
• opened or used products.
• products likely to deteriorate rapidly.
Return costs are borne by the buyer, except in case of seller error or non-compliant product.
8. Legal Guarantees
All products benefit from:
• the legal guarantee of conformity (articles 1649bis et seq. of the Belgian Civil Code),
• and the guarantee against hidden defects.
In the event of a defective or non-compliant product, the buyer must inform the seller within 5 days (with supporting photos) to agree on a replacement or refund.
9. Liability
The seller cannot be held responsible for:
• indirect damages (loss of income, data, use, etc.),
• delays attributable to carriers,
• or minor differences related to the artisanal nature of the products.
The total liability of the seller, whatever the cause, cannot exceed the total amount paid by the buyer.
10. Personal Data
Personal data collected during orders are processed in accordance with the General Data Protection Regulation (GDPR – EU 2016/679) and Belgian privacy legislation. They are used only for order processing, invoicing, delivery, and communication with the customer. No data is transmitted to third parties without prior consent. The buyer has at all times a right to access, rectify, and delete their personal data.
11. Force Majeure
The seller cannot be held responsible for the partial or total non-performance of an order in case of force majeure (natural disaster, war, pandemic, strike, serious illness, etc.).
In such a case, obligations are suspended for the duration of the event, without compensation for the buyer.
12. Modification of the GTC
The seller reserves the right to modify these GTC at any time. The applicable conditions are those in force on the date of the order.
13. Applicable Law and Competent Jurisdiction
These GTC are governed by Belgian law. In the event of a dispute, and after an attempt at amicable resolution, the courts of Brussels (Belgium) shall have exclusive jurisdiction.
